Terms of Use
Draft for legal review. These terms will be reviewed by a lawyer before Ballmark launches.
These terms are an agreement between you and Peter Nguyen (Lockwork Labs), Thorold, Ontario, who makes Ballmark. By creating an account or using Ballmark, you agree to them. Please also read our Privacy Policy.
1. Who can use Ballmark
You must be at least 13 years old. If you're 13 to 17, you'll be asked for a parent or guardian's email, and your account has junior limits (see the Privacy Policy). You need to give accurate information when you sign up, including your real name and date of birth, and keep your sign-in details to yourself. You're responsible for what happens on your account.
2. Fair play
Ballmark's levels and rankings only work if results are honest. When you use Ballmark, you agree to:
- report scores accurately, and only for matches that were played;
- confirm or dispute scores in good faith;
- not deliberately lose, or misreport your level, to get an easier rating or division ("sandbagging");
- not create fake accounts or report matches against them;
- treat other players, organizers and the Ballmark team with respect, with no harassment, threats or abuse.
We can correct or remove results, adjust ratings, or remove a player from rankings, leagues or Ballmark if these rules are broken.
3. Scores, levels and disputes
Levels are calculated from confirmed, ranked results; casual matches never change a level. A level is an estimate, not a guarantee of how anyone plays. If you disagree with a reported score, you can dispute it in the app. Disputes in a league can be decided by its organizer; others go to the Ballmark team, whose decision is final within Ballmark.
4. Leagues and organizers
Leagues on Ballmark are run by their organizers, not by Ballmark. Organizers set their league's rules, schedules and any fees, and are responsible for running it fairly and for collecting and refunding any fees themselves; Ballmark doesn't handle league payments. Organizers must have a person's permission before adding them as a guest with their contact details. Ballmark can step in on disputes, safety concerns or misuse, and can remove leagues that break these terms.
5. Your content
You own what you add to Ballmark, such as dispute notes and photos. You give us permission to store it and show it to the people it's meant for (for example, the players in a disputed match and the people deciding it), only to run Ballmark. Don't add anything that isn't yours to share, or that is unlawful, hateful or someone else's private information.
6. Playing safely
Tennis is a physical sport. Play within your limits and follow the rules of the courts you use. Ballmark doesn't own, run or inspect courts, and isn't responsible for court conditions, bookings, or anything that happens during a match or league.
7. Price
Ballmark is free to use. If we add optional paid features, we'll tell you the price and terms before you pay for anything.
8. The service
We work to keep Ballmark available and accurate, but it's provided "as is". Features can change, and the app may sometimes be unavailable. We aren't liable for indirect losses, or for anything arising from matches, leagues or other players, to the extent the law allows. Nothing in these terms limits rights you have under consumer protection law.
9. Ending your account
You can delete your account at any time (how). We can suspend or close accounts that break these terms. Match results may stay without your name, as described in the Privacy Policy, so other players' records stay correct.
10. Changes to these terms
If we change these terms, we'll update the date at the top and, for important changes, tell you in the app before they take effect. Continuing to use Ballmark after that means you accept the new terms.
11. Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
